Terms of Service

Welcome to Guacoholic — the community for people who take their guacamole seriously (and have a great time doing it). These Terms of Service ("Terms") explain the rules of the road for using guacoholic.club, our app, and everything we offer. We've written them in plain language because legal jargon is nobody's favorite dip.

By creating an account or using any part of Guacoholic, you agree to these Terms. If something doesn't work for you, please reach out to us at Info@guacoholic.club before using the site.

Owner review notice: These editable Terms are a working template and not legal advice. Guacoholic should have qualified counsel review and update them before relying on them.

1. Acceptance of Terms

By accessing or using guacoholic.club (the "Site") or any Guacoholic service, you confirm that you are at least 13 years old, that you've read and agree to these Terms, and that you have the legal capacity to enter into this agreement. If you're using Guacoholic on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

We may update these Terms from time to time. When we do, we'll update the "Last Updated" date above and notify active members via email. Continued use of the site after changes go into effect means you accept the updated Terms.

2. Membership Tiers

Guacoholic offers four membership options. Here's what each one includes:

Free Membership

Anyone can create a free account. Free members get access to the community feed, public recipes in the Recipe Rolodex, and the Ripeness Lab educational content. #cado redemptions and other member perks are not included at the free tier.

Monthly Membership — $10/month

All the perks of membership, billed monthly. Includes #cado redemptions (2 free guacamoles per month at participating restaurants), full Recipe Rolodex access, exclusive community features, and member-only content. Renews automatically each month unless cancelled.

Annual Membership — $100/year

Same great perks as the monthly plan, billed once per year. Best value for members who are in it for the long haul. Renews automatically each year unless cancelled.

Lifetime Founding Member — $300 (One-Time)

Limited to the first 100 members. Pay once, enjoy Guacoholic forever. Founding Members get everything included in paid membership, plus permanent recognition as a Founding Member, priority access to new features, and our eternal gratitude. This tier will close permanently once 100 slots are filled — no exceptions.

Guacoholic reserves the right to adjust pricing for monthly and annual plans with 30 days' notice to existing subscribers. Your rate is locked in for your current billing cycle at time of notice.

3. #cado Redemptions

Paid members (monthly, annual, and lifetime) receive 2 #cado redemptions per calendar month. Each #cado lets you enjoy one free guacamole at a participating Guacoholic restaurant partner.

How it works:

Show your digital Guacoholic membership card in the app at the time of your visit.
You must have an available #cado in your account to redeem.
A restaurant staff member will mark the #cado as used in the app — this is how redemptions are tracked.
Limit: one #cado redemption per restaurant per calendar year (so spread the guac love around!).
#cados do not roll over. Unused #cados expire at the end of each calendar month.
#cados have no cash value and cannot be transferred, sold, or gifted.

Restaurant participation is voluntary. Guacoholic cannot guarantee that any specific restaurant will be available at the time of your visit. Check the restaurant map in the app for current participating locations.

4. Recipe Rolodex

The Recipe Rolodex is where our community shares and discovers guacamole recipes. Members can submit their own creations for others to enjoy.

Your Content, Your Recipe:

You retain full ownership of any recipe you submit. We're not trying to steal your family's secret ingredient — promise.

License to Display:

By submitting a recipe to the Recipe Rolodex, you grant Guacoholic a non-exclusive, royalty-free, worldwide license to display, share, and feature that recipe on guacoholic.club, our app, and in Guacoholic promotional materials (social media, email newsletters, etc.). We may choose to highlight your recipe on the homepage or in a feature — we'll credit you by your display name.

Accuracy:

Recipes are submitted by community members and are not professionally tested or verified by Guacoholic. Make them at your own delicious risk.

Content Standards:

Submitted recipes must be original (or properly credited), must actually be guacamole-related, and must not infringe on anyone else's copyright. We reserve the right to remove recipes that violate these Terms or our community standards.

5. Ripeness Lab

The Ripeness Lab is our educational hub for everything avocado ripeness — how to pick 'em, store 'em, and time 'em perfectly.

All content in the Ripeness Lab is for informational and educational purposes only. It is not a guarantee of results. Avocados are living things and they don't always read the same playbook. Guacoholic is not liable for over-ripe, under-ripe, or otherwise uncooperative avocados.

Content in the Ripeness Lab is created or curated by Guacoholic and may be updated as new information becomes available.

6. Community Feed

The Community Feed is where Guacoholic members connect, share, and geek out about guac. We want it to stay fun, welcoming, and — obviously — guac-related.

Community Rules:

Keep it guac-related. This is a guacamole community. Off-topic promotional spam or unrelated content will be removed.
Be respectful. No hate speech, harassment, discrimination, or personal attacks of any kind. We're all here because we love guac — let's keep it that way.
No spam. Don't post repetitive content, unsolicited promotions, or links to unrelated sites.
No impersonation. Don't pretend to be someone you're not, including Guacoholic staff or other members.
No illegal content. Nothing that violates applicable laws, infringes on intellectual property, or promotes harmful activity.

Guacoholic moderates the Community Feed on a best-effort basis. We reserve the right to remove any content that violates these rules and to suspend or terminate accounts of repeat offenders. If you see something that violates these rules, please report it to Info@guacoholic.club.

7. Merch Store

Guacoholic operates a merch store where members and fans can purchase branded gear.

Orders & Payment:

All purchases are processed securely. By placing an order, you confirm that the payment information you provide is accurate and that you are authorized to use it.

Refunds & Returns:

We want you to love your merch. If something arrives damaged, defective, or just plain wrong, contact us at Info@guacoholic.club within 14 days of delivery and we'll make it right — replacement or refund, your choice. For sizing or preference issues, we accept returns of unworn, unwashed items within 30 days of delivery. Buyer covers return shipping.

Shipping:

We do not handle our own shipping, we use drop shipping services for any product in the store. Shipping times and costs are displayed at checkout. Guacoholic is not responsible for delays caused by third party providers, carriers, customs, or circumstances outside our control. We'll provide tracking information when available.

Digital Products:

If we offer digital products (downloads, printables, etc.), those sales are final.

8. Event RSVPs

Guacoholic hosts and facilitates events — tastings, meetups, cook-offs, and more. When you RSVP for an event, here's what to know:

Cancellation Policy:

If you need to cancel, please do so at least 48 hours before the event so we can offer your spot to someone on the waitlist. Cancellations made within 48 hours of the event may not be eligible for a refund, depending on the event.

No-Show Policy:

If you RSVP and don't show up without cancelling in advance, you may forfeit any ticket cost paid. Repeated no-shows may affect your ability to RSVP for future events.

Event Changes:

Guacoholic reserves the right to reschedule, modify, or cancel events due to low attendance, weather, venue issues, or other circumstances. If we cancel an event, you'll receive a full refund or a credit toward a future event — your choice.

9. Restaurant Partner Terms

Some restaurants listed on the Guacoholic map have entered into a separate Restaurant Partner Agreement with Guacoholic. By being listed, restaurant partners agree to:

Honor valid #cado redemptions from members with an active paid membership and an available #cado in their account.
Use the Guacoholic app or partner portal to mark redemptions as used.
Maintain accurate listing information (hours, location, etc.) on the Guacoholic platform.
Uphold the spirit of the Guacoholic community — welcoming, enthusiast-friendly, and guac-forward.

Guacoholic reserves the right to remove any restaurant from the platform that fails to honor the partner agreement or that receives consistent negative feedback from the community. Restaurant partner listings are subject to the full terms of the Restaurant Partner Agreement, which governs in the event of any conflict.

10. Payment & Billing

All payments are processed securely through our platform-hosted checkout and its payment-processing partners. By subscribing or making a purchase, you agree to the applicable checkout terms.

Subscriptions (Monthly & Annual):

Subscriptions auto-renew at the end of each billing period (monthly or annual) using the payment method on file.
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you'll keep access through the date you've already paid for.
No partial-period refunds are issued for mid-cycle cancellations.

Lifetime Founding Member:

The $300 Lifetime Founding Membership is a one-time payment.
You may request a full refund within 30 days of purchase if you're not satisfied.
After 30 days, the Lifetime Membership fee is non-refundable. This tier is permanent and does not require renewal.

Failed Payments:

If a payment fails, we'll notify you and give you a grace period to update your billing info. Access may be paused if payment cannot be collected after 3 reasonable attempts.

Taxes:

Applicable taxes may be added at checkout depending on your location.

11. Account Termination

We hope it never comes to this, but here's the deal:

You can delete your account at any time by contacting Info@guacoholic.club or using the account settings page.

Guacoholic reserves the right to suspend or permanently terminate accounts that:

Violate these Terms or our Community Feed rules
Engage in fraudulent activity (e.g., attempting to abuse #cado redemptions)
Harass other members or restaurant partners
Are determined, at our sole discretion, to be harmful to the community

If we suspend your account, we'll let you know why and give you an opportunity to respond unless the situation requires immediate action (e.g., serious abuse or fraud). Refunds upon termination for cause are issued at Guacoholic's discretion.

12. Limitation of Liability

Guacoholic is a community platform run by people who really love guacamole. We do our best to keep things running smoothly, but we can't guarantee perfection.

To the maximum extent permitted by law:

Guacoholic (and its team, partners, and affiliates) is not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or services.
Our total liability to you for any claim arising out of your use of Guacoholic shall not exceed the total amount you paid us in the 12 months preceding the claim.
We make no warranties — express or implied — about the reliability, accuracy, or fitness of content on the site, including recipes, ripeness guidance, restaurant listings, or event information.

Nothing in these Terms limits liability that cannot be excluded under applicable law (including consumer protection laws in New Mexico).

13. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Santa Fe, New Mexico, and both parties consent to personal jurisdiction there.

If you're located in the European Union, you may also have rights under applicable EU law, including GDPR. See Section 15 below.

14. Your Privacy Rights

Guacoholic respects your privacy. We collect only what we need to run the platform and make your experience great. We do not sell your personal data, use ad-tracking pixels, or share your information with third parties for advertising purposes.

California Residents (CCPA):

If you're a California resident, you have the right to know what personal information we collect, request deletion of your data, and opt out of any sale of personal information (we don't sell it, but the right is yours). To exercise these rights, email Info@guacoholic.club.

If you're in the European Union or United Kingdom, you have rights under GDPR including the right to access, correct, and delete your personal data, and the right to data portability. Our lawful basis for processing your data is either contract performance (to provide the services you signed up for) or legitimate interests. To exercise your rights, contact Info@guacoholic.club.

15. General

Entire Agreement: These Terms, together with our Privacy Policy and any separate agreements (like the Restaurant Partner Agreement), make up the full agreement between you and Guacoholic.

Severability: If any part of these Terms is found to be unenforceable, the rest of the Terms remain in full effect.

No Waiver: If we don't enforce a particular provision, that doesn't mean we've given up the right to enforce it later.

Assignment: You may not transfer your account or rights under these Terms to anyone else. Guacoholic may transfer its rights in connection with a merger, acquisition, or sale of assets.
